When a dispute blows up — product poorly presented, post removed 48h after publication, parallel partnership with a competitor — the brand has zero recourse. Nor does the influencer, by the way, when the brand fails to pay the balance after delivery.

Pitfalls specific to the Senegalese market
The "I forgot to post" trap. Without a strict schedule and time window, the influencer posts at 3am and you lose 80 % of reach. Our standard clause: "Publication between 6:00pm and 9:30pm GMT on agreed day, under penalty of 30 % of fee."
The competitor repost trap. Without category exclusivity, the influencer can post for your direct competitor the next week. Our clause: "The influencer commits to promoting no brand in category [X] for 21 days before and 30 days after publication."
The deleted post trap. Many influencers delete sponsored posts a few weeks later to "clean their feed", then a competitor repost arrives. Our clause: "Mandatory content retention for 12 months minimum, under penalty of 50 % fee refund."
The fuzzy image rights trap. A brand wanting to repost the Reel in Meta Ads for 90 days must negotiate that at signing, or the influencer can demand a supplement after the fact (and they do).

Does a WhatsApp contract have legal value in Senegal?
Yes, written exchange on WhatsApp binds parties if it clearly establishes the agreement (deliverables, price, dates). But in a dispute, proving its content is painful. A proper signed contract remains preferable.
Do I need a lawyer to draft these contracts?

What if the influencer doesn't deliver after the deposit?
Formal notice (email + WhatsApp + registered mail), then mediation. In practice, 90 % of disputes resolve in mediation. Court is rare and long (12-18 months in Dakar).
Can I combine long exclusivity with standard fee?
No. Exclusivity beyond 30 days must be priced at minimum +50 % of fee. Otherwise you're asking the influencer to refuse competing deals with no compensation, which will backfire.
