What application maintenance really covers in 2026
Application maintenance (called TMA in France) bundles four service families. Corrective maintenance fixes bugs. Add capped penalties, for example 5 to 15% of the monthly fee, and a monthly report showing ticket counts, actual response times and hours used. Without measurement, an SLA is just a promise.
Reversibility and code escrow: the clauses that protect you
Reversibility obliges the outgoing vendor to hand over, to you or a new vendor, everything needed to run the application: source code, deployment scripts, technical documentation, environment access and database. Price it in the contract, usually 5 to 10 days of work, EUR 3,000 to 6,000, payable only if you trigger it.
Source code escrow with a third party (in France the APP, a notary or an escrow service) costs EUR 300 to 800 per year. It guarantees access to the code if the vendor goes under. Finally, check that code ownership was assigned to you in the original development contract: without a written transfer of rights, maintenance does not fix anything.
Other points to check: a 12-month maximum commitment with tacit renewal cancellable on 3 months' notice, a cap on included corrective hours, whether unused enhancement days roll over, and annual price revision indexed on the Syntec index and capped at 3%.
